The sentences basically depend on different cases, and the judge at the time. The results will always be different, often due to mitigating factors during the court case. However, there are guidelines in place that talk about methamphetamine and sentences.

  • Controlled Substances Act
The Controlled Substances Act actually sets out all of the different drugs that are regulated in the United States of America. By regulated, it means that the drugs are either illegal or only legal for particular use - and hence, the law and the governing bodies must keep a particular eye on how the drugs are transported and used.

Methamphetamine is a regulated drug in that it is sometimes used in medical areas of work and research.

  • US Laws
In America, there are different schedules for drugs. Drugs are in particular categories, or 'schedules' to show how dangerous they are and how seriously they are taken in the eyes of the law. The placement of a drug in each one of these five different schedules, or five different categories, depends also on how it affects the health of the people that use the drug as well as the environment in general. The schedules might also look at whether the drug has any legal medical use - in this case, methamphetamine does have a legal use.

Even though methamphetamine has some kind of legal medical use, possessing or controlling the substance outside of this kind of use is a crime. It is completely illegal to be in possession of methamphetamine.

Sentences for the manufacture, control, possession and use of methamphetamine are also laid out within the sentencing guidelines.
